A binding contract is created between Monster Parties Limited and the buyer when the buyer receives communication from Monster Parties Limited in writing confirming acceptance of their order. The buyer accepts Monster Parties Limited terms and conditions.
Health & Safety
All toys supplied by Monster PartiesRTM comply with the European Toy Safety Regulations and bear the CE mark. An adult must supervise the use of any product at all times. The buyer is responsible for ensuring that all statutory government or local authority regulations are complied with in relation to the use of any products purchased from Monster PartiesRTM.
Prices All prices quoted on the site are subject to alteration without notice to take account of fluctuations in the cost of labour and materials and of alterations in rates of exchange and import duty that may occur in the course of manufacturing the products.
Monster Parties shall be entitled to adjust the price to take account of any alteration made by the buyer to the specifications or other information supplied by the buyer.
The price of products confirmed at the point of purchase will remain fixed during the transaction.
Copyright and Trade Marks All images, logos, trade marks are the property of Monster PartiesRTM and may not be reproduced, copied, or otherwise manipulated without our express permission in writing. Monster Parties, monster-parties and any other form describing our business are Registered Trade Marks belonging to Monster Parties Limited.
The copyright in any design, presentation, packaging and/or literature in connection with the products shall remain the property of the owner of that copyright and no right or licence (except as to the use for which the products are supplied) shall be granted hereby whether express or implied.
Warranties
Monster Parties Limited makes no warranty in respect of any products or service advertised by Monster PartiesRTM on this website but which is supplied by a supplier independent to Monster PartiesRTM.
Payment Where prices are displayed in currencies other than UK Pounds these will be converted into UK Pounds at the time of the transaction. The rate applied is controlled by the customers credit card company and not Monster PartiesRTM. In the event of a failure by the buyer to pay for the product without good cause, Monster PartiesRTM reserves the right to take action in order to recover the value of these goods and reasonable expenses.
Any such products or part of products so re-possessed may be re-sold without notice to the buyer and without prejudice to our right to claim damages against the buyer for any losses or expenses incurred, save that the proceeds of such sale shall be set off against any sums due from the buyer in respect of the products.
Monster Parties reserve the right at any time to charge interest on late payments with effect from the due date and on a day-to-day basis at a compound annual rate of 4% above Lloyds TSB plc base lending rate from time to time.
In the event that the buyer fails to make payment for the products or fails to take delivery of any of the products supplied by us, then all sums outstanding in respect of any products supplied by Monster Parties shall if not already paid in full become due and payable immediately. Monster Parties may at its absolute discretion and without prejudice to any other rights suspend all future deliveries of the products to the buyer under the contract in question and/or terminate any such contract(s) without liability upon our part. Failure to pay the balance outstanding will entitle Monster Parties to charge interest on the balance outstanding at the rate of 4% interest above Lloyds TSB Plc base rate.
Monster Parties will ensure that your order and any payment information you provide is kept private and confidential. Monster Parties will not retain any customer information beyond that necessary to confirm your order, despatch the products and trace the delivery. Monster PartiesRTM does not supply customer information to third parties other than as specifically stated herein (i.e. to enable the carrier to deliver the products).
Where the buyer is using the online payment method, Monster PartiesRTM uses a recognised online credit payment agency that has secure server software encryption to keep your transaction private and protected. Paying by this method will require the buyer to visit another website. Monster PartiesRTM accepts no responsibility and shall not be liable for errors or omissions on the part of the credit payment agency that results in the disclosure of confidential information, loss, expense or damage howsoever arising to the buyer. It is the responsibility of the buyer to read the terms of business of the credit payment agency before using the service.
The full price for ordered products must be paid prior to despatch. All orders must be paid for in Pounds Sterling, and in the case of payment by cheque, drawn on a bank account located within the United Kingdom.
Delivery and Risk in the Product Delivery charge rates will vary from time to time, however we will try to notify you as necessary.
Monster PartiesRTM shall not be liable for delay or failure to deliver products promptly if such failure arises due to force majeure or by reason of any delays occasioned by strikes, riots, lockouts or other labour trouble, war, fire, accident, mechanical failure, non-availability to Monster PartiesRTM of manufactured stock, parts, or materials; delay or failure of delivery of the products to Monster Parties by manufacturers suppliers or other persons; government action, legislation or regulation of any kind; Act of God, or any circumstances whatsoever outside our reasonable control.
Delivery within the UK will normally be made within 1 to 2 working days of despatch. Monster PartiesRTM will normally despatch an order within 1 working day of the order being confirmed and payment being received.
Returns
Complaints We will endeavour to respond to and resolve all complaints within 2 working days.
This does not affect your statutory rights as a consumer. Governing Law English Law shall govern the construction, validity and performance of these Conditions of Sale and of any agreement that exists between Monster PartiesRTM and the buyer in all respects. In any dispute with Monster Parties regarding these Conditions of Sale or the supply of products to the buyer, the parties shall submit to the jurisdiction of the English Courts.
You may return your goods for a full refund (less the cost of delivery) at any time up to 10 working days after you have received your parcel. The goods must be received by us in the same condition as they were sent with any packaging undamaged so that they remain in a saleable condition. We cannot accept the return of any foil-wrapped chocolates or non-packaged sweets. If we advise you that the goods you wish to purchase have to be obtained by us as a 'special order' these cannot be accepted for return except if they are in any way faulty. Please ensure that you package the items safely and you retain proof of posting. A refund will be issued crediting you using the same method that you used to pay for the goods originally.
If you are not completely satisfied with your purchase, for whatever reason, we guarantee to exchange or provide a full refund upon the return of the goods. The customer will need to bear the cost of returning the goods to us. If Monster PartiesRTM is at fault the postage costs will be refunded.
